修車廠內不算道路 酒駕擦撞判無罪

新北市八里一間修車廠的陳老闆，喝了酒，在廠區裡面移車，不小心擦撞到客戶的車輛，他也很老實的趕緊報案。但，警方一來，卻發現他喝酒，酒測值達0.71毫克，將他依照公共危險罪送辦。不過，法官認為，因為他是在廠區內開車，不是『道路』所以不算酒駕，判他無罪。

今年一月，陳老闆就像這樣開著自己的車，在修車廠裡挪來挪去，方便車輛進出，卻不小心擦撞到客戶的車，他沒多想立刻報警，結果反而讓自己酒駕被抓包，修車廠陳老闆：「我只想報出險。」結果被測酒測，當時警方聞到他的身上有酒味，酒測值達0.71，修車廠陳老闆：「警察說我公共危險，但我只是在廠區內又沒有出去。」

陳老闆很不服氣，竟然報警來抓自己，連老婆都罵他笨死啦，還好收到判決書後，夫妻倆總算露出笑臉，因為法官也認為，修車廠內不算是道路，而且一般的人車無法隨意經過所以不算公共危險罪，判決無罪，但如果是在廠區外的馬路上，情況就相反，一位高姓男子，喝酒後沒有騎機車，只是用牽的，法官卻認為他有駕駛行為，判刑4個月，得易科罰金12萬元，這兩起案例，都是由同一位法官審理，卻因為道路的認定問題，判決出現差異，不過酒駕就是不對，還是別以身試法。
